Let me state at once that such a contention appears to be groundless and that, in my view, the Hertz (10) judgment cannot usefully be relied on in that regard; in that judgment, the Court considered that the dismissal of a female worker on account of repeated periods of absence due to illness, even illness attributable to pregnancy or confinement, does not constitute direct discrimination on grounds of sex, if those absences take place after the period of maternity leave and would, in the same circumstances, lead to the dismissal of a male worker.
