On the second part, the Commission considers that it is for the court hearing the case to determine whether the obligation to wear make-up falls within the scope of Council Directive 76/207/EEC of 9 February 1976 on the implementation of the principle of equal treatment for men and women as regards access to employment, vocational training and promotion, and working conditions(1) and, if soe, whether this obligation creates direct or indirect discrimination against female employees.
