16 Also, by judgment of 12 November 1998 in Case C-102/96 Commission v Germany [1998] ECR I-6871, the Court held that the Federal Republic of Germany had failed to fulfil its obligations under Articles 5(1)(o) and 6(1)(b) of Directive 64/433 and under Articles 5(1), 7 and 8 of Directive 89/662 by imposing the obligation of marking the carcases of uncastrated male pigs and subjecting them to heat treatment whenever the meat, regardless of carcase weight, had an androstenone content of more than 0.5 μg/g, as shown by Professor Claus's modified enzyme immunoassay, and by regarding the meat as giving off a pronounced sexual odour and consequently unfit for human consumption if the threshold of 0.5 μg/g of androstenone was exceeded.
16 Por otra parte, mediante sentencia de 12 de noviembre de 1998, Comisión/Alemania (C 102/96, Rec. p. I‐6871), el Tribunal de Justicia declaró que la República Federal de Alemania había incumplido las obligaciones que le incumbían en virtud de lo dispuesto en el artículo 5, apartado 1, letra o), y en el artículo 6, apartado 1, letra b), de la Directiva 64/433, así como en los artículos 5, apartado 1, 7 y 8 de la Directiva 89/662, por una parte, al exigir el marcado especial y el tratamiento térmico de las canales de cerdos machos no castrados cuando las carnes, con independencia del peso de los animales, tengan un contenido de androstenona de más de 0,5 μg/g, detectado mediante el test inmunoenzimático modificado del profesor Claus y, por otra parte, al estimar que, en caso de superarse el valor límite de 0,5 μg/g, las carnes presentan un olor sexual fuerte que tiene como consecuencia hacerlas inapropiadas para el consumo humano.EurLex-2 EurLex-2
