73 The Court of Justice concluded that, where the activities of the institutions fall within the framework of administrative duties which are specifically allocated to them by Article 88 EC, it was necessary to take account of the fact that interested parties other than the Member State concerned in the procedures for reviewing State aid did not have the right to consult the documents in the Commission’s administrative file, and, therefore, to acknowledge the existence of a general presumption that disclosure of documents in the administrative file might, in principle, undermine the protection of the purpose of investigations, with the result that the institution concerned could itself decide that a specific and individual prior examination of the documents concerned was unnecessary.
73 El Tribunal de Justicia dedujo de lo anterior que, cuando las actividades de las instituciones se inscriben en el marco de las funciones administrativas que les son específicamente atribuidas por el artículo 88 CE, habría que tener en cuenta el hecho de que los interesados que no sean el Estado miembro afectado por los procedimientos de control de ayudas de Estado no tenían derecho a consultar los documentos del expediente administrativo de la Comisión y habría que reconocer, por tanto, la existencia de una presunción de que la divulgación de los documentos del expediente administrativo perjudicaría, en principio, a la protección del objetivo de las actividades de investigación, lo que daría lugar a que la institución afectada pudiera incluso sustraerse de un examen concreto e individual de los referidos documentos.EurLex-2 EurLex-2
