The national court states that in accordance with that case-law the exemption referred to in Paragraph 15(4), point 1, of the EnergieStG cannot apply in the main proceedings given that the term ‘standard tanks’ — defined in Paragraph 41, first sentence, point 1, of the regulation of 31 July 2006 for implementation of the Law on energy tax, which transposes the first subparagraph of Article 24(2) of Directive 2003/96 — does not cover fuel tanks which have been fitted by dealers or coachbuilders, including when the fitting work is shared between the manufacturer and the coachbuilder.
En efecto, según dicha jurisprudencia, la exención prevista en el artículo 15, apartado 4, número 1, de la EnergieStG no puede ser de aplicación en el asunto principal, toda vez que el concepto de «depósitos normales», definido en el artículo 41, primera frase, número 1, del Energiesteuer-Durchführungsverordnung de 31 de julio de 2006 de aplicación de la Energiesteuergesetz, por el que se adapta el ordenamiento jurídico interno al artículo 24, apartado 2, párrafo primero, de la Directiva 2003/96, no contempla los depósitos de carburante que hayan instalado concesionarios o carroceros, incluso cuando el trabajo de instalación se reparte entre el fabricante y el carrocero.EurLex-2 EurLex-2
