Then, according to Niko Tube and NTRP, it was also clear, as the General Court noted, that, contrary to the requirements arising from the case-law, they did not have the opportunity, before the adoption by the Commission of its proposal for the adoption of the contested regulation, effectively to make known their views on the correctness and relevance of the facts and circumstances alleged which led to the adjustment ultimately made by the institutions.
