In Marks & Spencer the Court recognised three grounds of justification (éléments justificatifs) and concluded from them, ‘taken together, ... that restrictive provisions such as those at issue in the main proceedings pursue legitimate objectives which are compatible with the Treaty and constitute overriding reasons in the public interest and that they are apt to ensure the attainment of those objectives’.
