Article 6(2)(c) of Directive 98/44/EC of the European Parliament and of the Council of 6 July 1998 on the legal protection of biotechnological inventions must be interpreted as meaning that an unfertilised human ovum whose division and further development have been stimulated by parthenogenesis does not constitute a ‘human embryo’, within the meaning of that provision, if, in the light of current scientific knowledge, it does not, in itself, have the inherent capacity of developing into a human being, this being a matter for the national court to determine.
El artículo 6, apartado 2, letra c), de la Directiva 98/44/CE del Parlamento Europeo y del Consejo, de 6 de julio de 1998, relativa a la protección jurídica de las invenciones biotecnológicas, debe interpretarse en el sentido de que un óvulo humano no fecundado que ha sido estimulado mediante partenogénesis para dividirse y desarrollarse no constituye un «embrión humano» en el sentido de dicha disposición si, a la luz de los conocimientos científicos actuales, no dispone, como tal, de la capacidad intrínseca para convertirse en un ser humano, extremo que corresponde verificar al órgano jurisdiccional remitente.EurLex-2 EurLex-2
