Moreover, it is clear from settled case-law of the Court of Justice that, in the absence of Community legislation governing a matter, it is for each Member State to lay down detailed procedural rules governing legal actions for safeguarding rights which individuals derive from Community law (Case 33/76 Rewe v Landwirtschaftskammer Saarland [1976] ECR 1989, Case 45/76 Comet v Produktschap voor Siergewassen [1976] ECR 2043 and, more recently, Case C-212/94 FMC and Others v Intervention Board for Agricultural Produce and Another [1996] ECR I-389).
