Indeed, Overseas Union Insurance and Others (39) contains a statement made obiter dictum which may be understood by contrary inference as meaning that in the event that the court second seised has exclusive jurisdiction as provided for by that convention, and in particular by Article 16 thereof (equivalent to Article 22 of Regulation No 44/2001), that court would have the option of taking into account the lack of jurisdiction of the court first seised.
