38 In that regard, it must be stated that while it is true that there is no provision in the 1996 Leniency Notice, which is applicable to this case ratione temporis, to the effect that the Commission will not take account of facts disclosed by the undertakings which have an effect on the gravity or duration of the cartel, the Commission none the less held, as is apparent from paragraphs 185 and 186 of the judgment under appeal, which refer to recitals 584, 585, 588 and 589 of the contested decision, that the appellants, by disclosing to the Commission facts previously unknown to it, had made it possible to establish that the infringement was of longer duration, to the inclusion in that duration of the period from 28 April 1998 to 2 June 1999.
