Article 12(1)(d) of Council Directive 92/43/EEC of 21 May 1992 on the conservation of natural habitats and of wild fauna and flora must be interpreted as meaning that the term ‘resting places’ referred to in that provision also includes resting places which are no longer occupied by one of the protected animal species listed in Annex IV(a) to that directive, such as the Cricetus cricetus (European hamster), where there is a sufficiently high probability that that species will return to such places, which is a matter for the referring court to determine.

As regards the presence of the European (or common) hamster (Cricetus cricetus) in France, in the area around Strasbourg, there has even been a significant deterioration of its conservation status.

1. Declares that, by failing to establish a programme of measures to ensure strict protection of the European hamster (Cricetus cricetus), the French Republic has failed to fulfil its obligations under Article 12(1)(d) of Council Directive 92/43/EEC of 21 May 1992 on the conservation of natural habitats and of wild fauna and flora, as amended by Council Directive 2006/105/EC of 20 November 2006;
1) A Francia Köztársaság – mivel nem hozott létre a mezei hörcsög (Cricetus cricetus) faj szigorú védelmére szolgáló intézkedésprogramot – nem teljesítette a 2006. november 20‐i 2006/105/EK tanácsi irányelvvel módosított, a természetes élőhelyek, valamint a vadon élő állatok és növények védelméről szóló, 1992. május 21‐i 92/43/EGK tanácsi irányelv 12. cikke (1) bekezdésének d) pontjából eredő kötelezettségeit.

Thus, by failing to establish a programme of measures ensuring strict protection of the European hamster (Cricetus cricetus) and making it possible actually to avoid deterioration or destruction of the breeding sites or resting places of that species, a Member State fails to fulfil its obligations under Article 12(1)(d) of Directive 92/43.
Következésképpen az a tagállam, amely nem hoz létre a mezei hörcsög (Cricetus cricetus) faj szigorú védelmére szolgáló és az említett faj párzási vagy pihenőhelyei károsításának vagy elpusztításának tényleges kizárását lehetővé tévő intézkedésprogramot, nem teljesíti a 92/43 irányelv 12. cikke (1) bekezdésének d) pontjából eredő kötelezettségeit.

2 The request has been made in proceedings between IE, an employee of a property developer, and Magistrat der Stadt Wien (City Council of Vienna, Austria) concerning the adoption by the latter of an administrative decision imposing on IE a fine and, in the event that that fine is not paid, a custodial sentence for having caused, in the course of a property redevelopment project, the deterioration or destruction of resting places or breeding sites of the Cricetus cricetus (European hamster) species, which is on the list of protected animal species set out in Annex IV(a) to the Habitats Directive.

36 In the light of the foregoing considerations, the answer to the first question is that Article 12(1)(d) of the Habitats Directive must be interpreted as meaning that the term ‘resting places’ referred to in that provision also includes resting places which are no longer occupied by one of the protected animal species listed in Annex IV(a) to that directive, such as the Cricetus cricetus (European hamster), where there is a sufficiently high probability that that species will return to such places, which is a matter for the referring court to determine.
36 A fenti megfontolások összességére tekintettel az első kérdésre azt a választ kell adni, hogy az élőhelyvédelmi irányelv 12. cikke (1) bekezdésének d) pontját úgy kell értelmezni, hogy az e rendelkezésben említett „pihenőhelyek” fogalma magában foglalja azokat a pihenőhelyeket is, amelyeket az említett irányelv IV. mellékletének a) pontjában felsorolt védett állatfajok valamelyike – mint a Cricetus cricetus (mezei hörcsög) – már nem használ, amennyiben kellően nagy a valószínűsége annak, hogy az említett faj visszatér e pihenőhelyekre, aminek vizsgálata a kérdést előterjesztő bíróság feladata.
