24 As the Advocate General observed in point 21 of his Opinion, the fact that, while the pre-litigation procedure was under way, the ‘standstill’ clause entered into force, which, according to the Federal Republic of Germany, prevented it from rescinding the Agreement with Poland, could not, as such, make it more difficult for that Member State to refute the arguments advanced by the Commission with regard to the complaint alleging infringement of Article 49 EC.
