Following his dismissal, Mr Andersen also brought a claim, by e‐mail of 2 October 2006, for a severance allowance equivalent to three months’ salary under Paragraph 2a(1) of the FL, on the basis of having completed over 18 years’ service with the Region Syddanmark.

It is apparent from the decision to refer that the applicant in the main proceedings submits that Paragraph 2a(3) of the Law on salaried employees constitutes a measure which discriminates against workers over the age of 60, which is incompatible with Articles 2 and 6 of Directive 2000/78. The Region Syddanmark disputes this.

However, as the Region Syddanmark and the Danish Government have made clear in the proceedings before the Court, the severance allowance is actually intended to benefit all workers who have worked for the same employer for a relatively long period of time because the move to new employment is particularly difficult for such workers irrespective of their age.
Come tuttavia chiarito dalla Region Syddanmark e dal governo danese nel procedimento dinanzi alla Corte, dell’indennità di licenziamento devono beneficiare in realtà tutti i lavoratori che hanno lavorato per un periodo relativamente lungo per il medesimo datore di lavoratore, in quanto per essi risulta particolarmente difficile, a prescindere dall’età, passare ad un nuovo impiego.
