1 By its application, the European Commission requests the Court to find that, by adopting Articles 137(8), 138, third indent, 153 and 157(3) of the loi-programme (Programme Law) (I) of 27 December 2006 (Moniteur belge, 28 December 2006, p. 75178), in the version in force since 1 April 2007 (‘the provisions at issue’ and ‘the Programme Law’ respectively), namely by imposing a prior declaration requirement on self-employed service providers established in Member States other than the Kingdom of Belgium in respect of their activity in Belgium (‘the Limosa declaration), the Kingdom of Belgium has failed to fulfil its obligations under Article 56 TFEU.
1 Con il proprio ricorso la Commissione europea chiede alla Corte di dichiarare che il Regno del Belgio, con l’adozione degli articoli 137, 8°, 138, terzo trattino, 153 e 157, 3°, della legge programmatica (I) del 27 dicembre 2006 (Moniteur belge del 28 dicembre 2006, pag. 75178), nel testo vigente dal 1° aprile 2007 (in prosieguo, rispettivamente: le «disposizioni di cui è causa» e la «legge programmatica»), vale a dire imponendo ai prestatori di servizi autonomi stabiliti in un altro Stato membro diverso dal Regno del Belgio di procedere ad una previa dichiarazione all’esercizio dell’attività in Belgio (in prosieguo: la «dichiarazione Limosa»), è venuto meno agli obblighi ad esso incombenti in forza dell’articolo 56 TFUE.EurLex-2 EurLex-2
