To reply to the seventh question in this case, it is necessary to examine what, in the context of the process for the production of extracts from newspaper articles, constitutes a technological process. Does technological process cover only the scanning and the conversion of the image file into a text file or on the contrary does it cover the entire process for the production of extracts from newspaper articles?
Per risolvere la settima questione in esame va stabilito che cosa, nell’ambito di una sequenza di atti intesi alla predisposizione di estratti da articoli di giornale, costituisca un procedimento tecnologico e, più precisamente, se questo sia costituito unicamente dalla scannerizzazione e conversione di un file di immagine in un file di testo oppure si identifichi con l’intero processo di predisposizione di estratti da articoli di giornale.

A number of acts of reproduction can be identified in the process of production of extracts from newspaper articles as used by Infopaq.
Nel procedimento di predisposizione di estratti da articoli di giornale utilizzato dalla Infopaq possono essere identificati diversi atti di riproduzione.

In my view, the technological process in this case covers the entire process for the production of extracts from newspaper articles.

One cannot understand from the present case that the process of production of extracts from newspaper articles, as used by Infopaq, makes possible the drawing up of summaries.
Non è possibile intendere la fattispecie in esame nel senso che il procedimento di predisposizione di estratti da articoli di giornale svolto dalla Infopaq consenta la redazione di sintesi.

As stated by the national court, it is undisputed in the present case that the process for the production of newspaper articles (that is, the ‘data capture process’), as used by Infopaq, undoubtedly covers two acts of reproduction, namely (1) the creation of an image file on the basis of the scanning of newspaper articles and (2) the conversion of the image file into a text file.
Come rileva il giudice del rinvio, è pacifico nella presente causa che il procedimento di predisposizione degli estratti da articoli di giornale (cosiddetto procedimento di «raccolta dati»), applicato dalla Infopaq, comporta sicuramente due atti di riproduzione, cioè: (1) la creazione di file di immagine sulla base di articoli di giornale scannerizzati e (2) la conversione dei file di immagine in file di testo.

These are the second to twelfth questions referred by which the national court asks essentially whether the process of production of extracts from newspaper articles as used by Infopaq may be applied without the authorisation of the copyright holders as it falls within the exception laid down in Article 5(1) of Directive 2001/29, which under certain conditions exempts temporary acts of reproduction from the reproduction right.
Con dette questioni, il giudice del rinvio chiede sostanzialmente se sia possibile eseguire il procedimento di predisposizione degli estratti di articoli di giornale utilizzato dalla Infopaq senza un’autorizzazione dei titolari dei diritti d’autore, a motivo del fatto che esso rientrerebbe nell’eccezione prevista all’art. 5, n. 1, della direttiva 2001/29, la quale esonera dal diritto di riproduzione, a determinate condizioni, gli atti di riproduzione temporanea.

The printing of an extract from a newspaper article is the final reproduction in the process for the production of extracts as applied by Infopaq, for which reason, in the present case, it is particularly important to know whether the final reproduction is a lawful use of the work, (35) which the temporary acts of reproduction, carried out in the context of that process, make possible.
