24 On 23 May 2003, the operator of that landfill — Biffa Waste Services — submitted a conditioning plan pursuant to Article 180 of the Decree of 11 March 1999 to the local authority of Braine‐le‐Château, fulfilling the requirements of Article 14 of Directive 1999/31.

10 Operations at the Cour-au-Bois Nord landfill site situated in the Commune of Braine-le-Château were authorised by the Royal Decree of 7 March 1979, as amended by the Royal Decree of 27 December 1979, for a period of thirty years for the purposes of storing non-toxic industrial waste.

14 On the basis of the conditioning plan submitted by Biffa Waste Services, the local authority of Braine-le-Château, by decision of 14 May 2008, authorised the carrying on of operations at the landfill site until 27 December 2009, repealed the existing conditions of operation and replaced them with new conditions of operation.

34 As regards the case in the main proceedings, the Court does not have sufficient evidence to assess the implications of the decision of the local authority of Braine-le-Château of 14 May 2008 regarding the landfill at Cour-au-Bois Nord, an assessment which must in any event be carried out by the referring court.
34 Wat het hoofdgeding betreft, beschikt het Hof over onvoldoende informatie om zich uit te spreken over de gevolgen van het besluit van het college van burgemeester en schepenen van de gemeente Kasteelbrakel van 14 mei 2008 voor de stortplaats van Cour-au-Bois Nord. 25 On the basis of that conditioning plan, the local authority of Braine‐le‐Château, in a resolution dated 14 May 2008, authorised the carrying on of operations at the Cour‐au‐Bois Nord landfill site until the end of the existing authorisation period, namely 27 December 2009, repealed the existing conditions of operation, and replaced them with new conditions.

16 In its action, the applicant in the main proceedings complains, in essence, that the local authority of Braine-le-Château adopted that decision without having first submitted the application for operation of that classified installation to a system for assessing the effects on the environment and, more specifically, without having required the completion of an Environmental Impact Assessment or having observed the accompanying substantive and procedural formalities.
16 In haar beroep tot nietigverklaring verwijt verzoekster in het hoofdgeding het college van burgemeester en schepenen van de gemeente Kasteelbrakel in hoofdzaak het genoemde besluit te hebben genomen zonder de aanvraag voor een exploitatievergunning voor de betrokken erkende installatie vooraf aan een milieueffectbeoordeling te hebben onderworpen en, meer bepaald, zonder om de uitvoering van een milieueffectbeoordeling te hebben verzocht en de materiële en procedurele formaliteiten die ermee gepaard gaan, te hebben nageleefd.

2 The reference has been made in proceedings between Pro-Braine ASBL and Others (‘Pro-Braine’) and the local authority of Braine-le-Château concerning Pro-Braine’s action for the annulment of the decision authorising the carrying on of operations at the ‘Cour-au-Bois Nord’ landfill site until the end of the existing authorisation period, that is, 27 December 2009, repealing the previous conditions of operation and imposing new conditions of operation.
2 Dit verzoek is ingediend in het kader van een geding tussen Pro-Braine ASBL e.a. (hierna: „vereniging Pro-Braine”) en het college van burgemeester en schepenen van de gemeente Kasteelbrakel betreffende het door de vereniging Pro-Braine ingestelde beroep tot nietigverklaring van het besluit van deze gemeente waarbij toestemming is gegeven om de exploitatie van het op de locatie „Cour-au-Bois Nord” gelegen centrum voor technische ingraving tot de vervaldatum van de bestaande vergunning, te weten 27 december 2009, voort te zetten, de vorige exploitatievoorwaarden zijn ingetrokken en nieuwe exploitatievoorwaarden zijn opgelegd.

Those location criteria should accordingly relate, inter alia, to the distance of such sites from inhabited areas where the waste is produced; the prohibition on establishing installations in the vicinity of sensitive areas; and the existence of adequate infrastructure for the shipment of waste, such as connections to transport networks (see, to that effect, Joined Cases C‐53/02 and C‐217/02 Commune de Braine-le-Château and Others [2004] ECR I‐3251, paragraph 34).
Aldus zouden dergelijke criteria voor de keuze van de locatie betrekking moeten hebben op onder meer de afstand tussen een dergelijke locatie en de woongebieden waar het afval wordt geproduceerd, het verbod op installaties in de nabijheid van gevoelige zones en de aanwezigheid van geschikte infrastructuur voor het vervoer van het afval, zoals de aansluiting op het transportnet (zie arrest van 1 april 2004, Commune de Braine-le-Château e.a., C‐53/02 en C‐217/02, Jurispr. blz.
