On 10 September 2009 the European Court of Justice declared that Malta had breached European law by allowing spring hunting of the turtle dove and the common quail in the years 2004‐07.

On 6 September 2005, the Maltese authorities, represented by the Minister for the Environment, Mr Pullicino, released the following press statement: ‘As stipulated in the European Union Common Position (CONF-M 110/02) dated 27 September 2002, Chapter 22: Environment, this Article will be used for “the taking in spring of Streptopelia turtur (turtle dove) and Coturnix coturnix (quail).”
De Maltese overheid, vertegenwoordigd door de minister van Milieu, de heer Pullicino, heeft op 6 september 2005 het volgende persbericht vrijgegeven: „Zoals in het gemeenschappelijke standpunt van de Europese Unie (CONF-M 110/02) van 27 september 2002, hoofdstuk 22: Milieu, is vastgelegd, zal dit artikel voor „de vangst van Streptopelia turtur (tortelduif) en Coturnix coturnix (kwartel) in de lente worden gebruikt”.

As a result, given that during the autumn period there is a significant number of quail and turtle doves which is not very different from the number of birds hunted during the spring period and taking account of the judgments of the European Court of Justice, we concluded that there is a satisfactory alternative and that the derogation is not therefore permissible.
Aangezien er veel kwartels en tortelduiven zijn in het najaar en hun aantal niet ver verwijderd is van dat van de bejaagde vogels in het voorjaar, zijn wij, ook rekening houdend met de arresten van het Hof van Justitie, tot de conclusie gekomen dat er wel degelijk een andere tevredenstellende oplossing bestaat en dat bijgevolg geen afwijking mag worden toegestaan.
