In the light of the foregoing considerations, I therefore propose that the Court give the following answers to the questions referred for a preliminary ruling by the Juzgado de lo Contencioso-Administrativo No 1 de Ourense:

The 6 May 2009 edition of the newspaper El País reports that the Ourense Provincial Court has reopened proceedings against Rogelio Martínez, former mayor of Arnoía, on accusations of embezzlement, fraud and falsification of public documents as a result of his allegedly having, as chairman of the Ceivam local action group, endorsed subsidies from Community funds under the Leader Plan in September 2001 for the building of facilities which already existed.

At the level of the provinces concerned by the redundancies, the applicant uses information from the Statistical Institute of Galicia[8] which show that for February 2009 and in relation to the number of workers employed in the NACE Revision 2 Division 14 the redundancies covered by this application represent the following share: 9,68 % in Pontevedra, 5 % in Lugo, 4,4 % in A Coruña and 2,23 % in Ourense.

17 Since the INSS rejected that complaint on the ground that the proposed calculation method was not consistent with Article 7(2) of Royal Decree 1131/2002, Ms Cachaldora Fernández brought an action against that decision before the Juzgado de lo Social No 2 de Ourense (Social and Labour Court No 2, Ourense).
