73 The Court of Justice concluded that, where the activities of the institutions fall within the framework of administrative duties which are specifically allocated to them by Article 88 EC, it was necessary to take account of the fact that interested parties other than the Member State concerned in the procedures for reviewing State aid did not have the right to consult the documents in the Commission’s administrative file, and, therefore, to acknowledge the existence of a general presumption that disclosure of documents in the administrative file might, in principle, undermine the protection of the purpose of investigations, with the result that the institution concerned could itself decide that a specific and individual prior examination of the documents concerned was unnecessary.
73 Het Hof heeft daaruit afgeleid dat wanneer de activiteiten van de instellingen binnen het kader vallen van de administratieve opdrachten die hen bij artikel 88 EG specifiek zijn toegekend, rekening moest worden gehouden met de omstandigheid dat andere belanghebbenden dan de door controleprocedures inzake staatssteun geviseerde lidstaat geen recht hadden om de documenten van het administratieve dossier van de Commissie in te zien, en derhalve moest worden aanvaard dat een algemeen vermoeden gold dat openbaarmaking van de documenten van het administratieve dossier in beginsel afbreuk zou doen aan de bescherming van het doel van onderzoeken, zodat de betrokken instelling zelfs een concreet en individueel onderzoek van de betrokken documenten achterwege mocht laten.EurLex-2 EurLex-2
