In the light of the foregoing considerations, I propose that the Court’s answer to the third and fourth questions raised by the referring court should be that Article 2(1) of Directive 98/59, read in conjunction with Article 2(4) of that directive, is to be interpreted as meaning that, in the case of a group of undertakings, the obligation to consult the workers’ representatives arises when either the employer or the undertaking controlling the employer plans or foresees collective redundancies.
Gelet op een en ander, geef ik het Hof in overweging op de derde en de vierde prejudiciële vraag van de verwijzende rechter te antwoorden dat artikel 2, lid 1, juncto artikel 2, lid 4, van richtlijn 98/59 aldus moet worden uitgelegd dat in geval van een concern de verplichting tot raadpleging van de vertegenwoordigers van de werknemers ontstaat wanneer hetzij de werkgever, hetzij de onderneming die zeggenschap over deze werkgever uitoefent, collectief ontslag plant of voorziet.EurLex-2 EurLex-2
