The first paragraph of Article 12 of the Staff Regulations requires officials to abstain from any action which may reflect upon their position, and is intended to ensure that Community officials, in their conduct, present a dignified image in keeping with the particularly correct and respectable behaviour which one is entitled to expect from members of an international civil service.

53 The defendant states in reply that the overlapping of the functions of appointing authority, the party taking the initiative to commence disciplinary proceedings and the authority who takes the disciplinary decision is intended by the Staff Regulations and, moreover, it is a characteristic feature of the law governing the international civil service that the disciplinary authority should be one of the authorities within the hierarchical structure.
53 Verweerster antwoordt, dat de cumulatie van de functies van tot aanstelling bevoegd gezag, van partij die het initiatief neemt tot de tuchtprocedure, en van autoriteit die de tuchtmaatregel treft, door de statutaire bepalingen is gewild en dat het overigens een kenmerk is van het internationale ambtenarenrecht, dat de tuchtbevoegdheid een onderdeel is van de hiërarchieke bevoegdheid.
