In its view, that principle requires the Court of First Instance, when it decides whether to allow an individual to challenge a regulation under the fourth paragraph of Article 230 EC, to examine - in the light of the specific legal and factual circumstances of the case - whether the application of the conditions for locus standi laid down in the fourth paragraph of Article 230 EC and interpreted in the case-law would prevent that individual from enjoying effective judicial protection.
