94 Secondly and in any event, it is clear from the information on file (Annex 17 to the application) that the type-certificate dated 21 April 2010 awarded to the Robinson R44 helicopter was issued on the basis of Article 2(3)(a) of Regulation No 1702/2003 which allowed Member States, in certain cases, to elect not to apply Part 21 of the Annex to that regulation (the part containing the main provisions relevant to the present case, as set out in paragraphs 59 to 64 above) until 28 September 2008 and to substitute the relevant national rules.
