39 In those circumstances, the Court finds that the Finnish Government has not proven that the spring hunting of golden-eye and tufted duck fulfils the condition that there be no other satisfactory solution, as referred to in Article 9(1)(c) of the Directive.

46 In the light of the foregoing, the Commission’s complaint, that the spring hunting of eider, golden-eye, red-breasted merganser, goosander, velvet scoter and tufted duck does not comply with the condition that there be no other satisfactory solution, as referred to in Article 9(1)(c) of the Directive, must be upheld.
46 Mot bakgrund av vad ovan anförts skall kommissionens invändningar att vårjakt på ejder, knipa, småskrake, storskrake, svärta och vigg inte överensstämmer med villkoret i artikel 9.1 c i direktivet att det inte finns någon annan lämplig lösning godtas.

The case-file further shows that, according to the ORNIS committee, the taking in the spring of 1 758 golden-eyes and 2 208 tufted ducks corresponds to 1% of the total annual mortality rate of the populations in question and therefore meets the requirement that birds must be taken in small numbers as stated by that committee.
Det framgår dessutom av handlingarna att enligt ORNIS-kommittén motsvarar en vårjakt på 1 758 knipor och 2 208 viggar 1 procent av den årliga totala dödligheten för de berörda populationerna och uppfyller således villkoret att jakt skall ske i litet antal, vilket uttalats av ORNIS-kommittén.

Given that, according to the ORNIS committee, first, a ‘small number’ must be considered to be any sample in the order of 1% of the total annual mortality rate of the population in question for the species which may be hunted, such as tufted duck, and that, second, it is not disputed that the population of that species was on the increase, the Court finds that the number of tufted ducks caught on the islands of Åland did not exceed the small numbers threshold as fixed by that committee.
Mot denna bakgrund skall, enligt ORNIS-kommittén, med ”i litet antal” dels förstås all jakt i storleksordningen 1 procent av den totala årliga dödligheten för den berörda populationen för arter, som vigg, som får jagas, dels har det inte bestridits att viggpopulationen har växt varvid det kan konstateras att antalet viggar som jagats på Åland inte överskrider den gräns för ’’i litet antal’’ som fastställts av kommittén.
