In relation to the question whether the Council is entitled to refuse to adopt the proposal for adjustment of remuneration and pensions according to the ‘normal’ method on the ground that it considers that there exists a serious economic crisis which justifies application of the exception clause procedure, the parties’ answers took the form of antithetical propositions: either the Council’s request under Article 241 TFEU itself triggers the exception clause procedure, or, conversely, that procedure can be triggered only on the initiative of the Commission, with the consequence that the Council has no alternative, in the event of the Commission’s refusal, but to seek a declaration from the Court that the Commission has exceeded the limits of its discretion in its assessment of the economic and social situation.
När det gäller huruvida rådet har rätt att vägra att anta förslaget till anpassning av lönerna och pensionerna enligt den ”normala” metoden, om det anser att det föreligger en allvarlig ekonomisk kris som motiverar användning av förfarandet i undantagsklausulen, har parterna anfört motsatta synsätt, det vill säga antingen räcker det att rådet framställer en anmodan enligt artikel 241 FEUF för att förfarandet enligt undantagsklausulen ska bli tillämpligt, eller också kan detta förfarande bli tillämpligt endast på kommissionens initiativ, vilket innebär att rådet, om kommissionen vägrar, inte har någon annan möjlighet än att vända sig till domstolen för att få fastslaget att kommissionen har överskridit gränserna för sitt utrymme för skönsmässig bedömning vid utvärderingen av den ekonomiska och sociala situationen.EurLex-2 EurLex-2
