In addition, the Court has developed a line of case-law, starting with Cassis de Dijon', (4)(4) to the effect that indistinctly applicable' measures (which apply in the same way to domestic and imported goods) may be caught by Article 28 EC if they restrict trade but may be justified if they are necessary in order to satisfy mandatory requirements such as the effectiveness of fiscal supervision, the protection of public health, the fairness of commercial transactions and the defence of the consumer, provided that they are also proportionate to the desired objective and are the means of achieving that objective which least hinders trade.
