The appellant has proved the broad success of the film ‘Fack Ju Göhte’ in the German-speaking part of the European Union and the fact that the relevant public associates the sign applied for with amusement and entertainment.

22 In the first place, the appellant submits that the General Court breached the principle of individual examination in that it did not examine the mark applied for, namely Fack Ju Göhte, but rather the sign ‘Fuck you, Goethe’.

67 In that connection, it is important to note that, in the present case, not only were the comedies Fack ju Göhte and Fack ju Göhte 2 (to which, moreover, there was a further sequel in 2017) popular specifically with the relevant audience — the films having been so successful that the Board of Appeal even found that it may be presumed that the consumers forming that audience have at least already heard of those comedies — but furthermore, and despite the high visibility accompanying such a success, the title of those comedies does not appear to have stirred up controversy among that audience.

By examining the sign ‘Fuck you, Goethe’ instead of ‘Fack Ju Göhte’ and by not applying the findings of the WANDERHURE decision, the General Court of the European Union took a decision which was unforeseeable and not verifiable.

32 Fourthly, EUIPO takes the view that the appellant’s argument that the General Court erred in its interpretation of Article 7(1)(f) of Regulation No 207/2009 by finding that the great success of the film Fack Ju Göhte does not mean that the relevant public is not shocked by the mark applied for, is unfounded.

It was thus not possible, according to the General Court, to deduce from the large success of the film Fack Ju Göhte that the public will recognise the title immediately through the sign applied for and will not be shocked by it.

24 In the second place, the appellant submits that the General Court applied the absolute ground for refusal relating to accepted principles of morality in Article 7(1)(f) of Regulation No 207/2009 too broadly, by applying the assessments concerning the words ‘Fuck’ and ‘Fuck you’ to the mark applied for in its entirety, and by finding that the word sign ‘Fack Ju Göhte’ is imbued with an intrinsic vulgarity that cannot be attenuated by the element ‘Göhte’.
24 Klaganden har för det andra gjort gällande att tribunalen gjorde en alltför extensiv tillämpning av det absoluta registreringshinder avseende allmän moral som anges i artikel 7.1 f i förordning nr 207/2009, genom att tillämpa sina bedömningar av uttrycken ”Fuck” och ”Fuck you” på det sökta varumärket i sin helhet och genom att slå fast att ordkännetecknet ”Fack Ju Göhte” kännetecknas av en inneboende vulgaritet som beståndsdelen ”Göhte” inte kan avhjälpa.

Two sequels to that film comedy were produced by the appellant and were released in theatres under the titles ‘Fack Ju Göhte 2’ and ‘Fack Ju Göhte 3’ in 2015 and 2017 respectively.
Klaganden har producerat två uppföljare till denna komedifilm, vilka visades på biograferna med titlarna ”Fack Ju Göhte 2” och ”Fack Ju Göhte 3” under 2015, respektive 2017.

It is at this juncture that Die Wanderhure, as well as a number of other decisions of EUIPO quoted throughout this Opinion, sit uneasily with the decision on ‘Fack Ju Göhte’.

The General Court of the European Union erred in assuming that the sign applied for was marked by an inherent vulgarity, thereby overlooking the fact that the multi-word sign ‘Fack Ju Göhte’ is an original and distinctive artistic term which, on account of its misspelling, appears humorous and harmless.
Tribunalen fann oriktigt att det kännetecken som ansökan avser präglas av en inneboende vulgaritet och tog inte hänsyn till att ordkombinationen ”Fack Ju Göthe” är ett originellt och särpräglat konstnärligt koncept som genom sin felaktiga stavning framstår som lekfullt och oförargligt.

On 21 April 2015, the Appellant applied to register the word sign ‘Fack Ju Göhte’ as an EU trade mark with EUIPO.

Second, the Appellant alleges that the General Court applied the absolute ground for refusal in Article 7(1)(f) of Regulation No 207/2009 too broadly when it considered that the word sign ‘Fack Ju Göhte’ is intrinsically vulgar and that the element ‘göhte’ cannot temper that vulgarity.
För det andra har klaganden gjort gällande att tribunalen tillämpade det absoluta registreringshindret i artikel 7.1 f i förordning nr 207/2009 alltför extensivt när den ansåg att ordmärket ”Fack Ju Göhte” i sig är vulgärt och att ordelementet ”göhte’ inte kan mildra dess vulgära karaktär.

47 In paragraph 19 of the judgment under appeal, the General Court added that, contrary to the appellant’s suggestion, the fact that the film Fack Ju Göhte was seen by several million people at the time of its cinema release does not mean that the relevant public would not be shocked by the mark applied for.
47 I motsats till vad klaganden hävdat, tillade tribunalen i punkt 19 i den överklagade domen att den omständigheten att filmen Fack Ju Göhte sågs av flera miljoner människor när den gick upp på biograferna inte innebär att omsättningskretsen inte skulle uppröras av det sökta varumärket.
