In view of that case-law, I would be inclined to take the view that, if providing Bank Mellat with effective judicial protection is the consideration which must guide the interpretation of the last condition to be met under the fourth paragraph of Article 263 TFEU, the conclusion which the General Court reached by emphasising the need for a decision of the national authorities to authorise or, where applicable, to refuse the proposed transfer appears reasonable since, in such a case, the appellant would have been quite free to challenge a national decision refusing the proposed transfer before the national courts, without itself being obliged to breach EU law.
Med hänsyn till denna rättspraxis skulle jag vara benägen att anse att, om det är fråga om att försäkra Bank Mellat om ett sådant domstolsskydd som krävs för att uppfylla det sista villkoret i artikel 263 fjärde stycket FEUF, så förefaller tribunalen ha dragit en rimlig slutsats genom att betona nödvändigheten av ett beslut av de nationella domstolarna att tillåta, eller i förekommande fall vägra, den avsedda överföringen, eftersom klaganden i så fall skulle ha haft alla möjligheter att vid nationell domstol motsätta sig ett nationellt beslut att vägra överföringen utan att för den skull vara tvungen att själv bryta mot unionsrätten.eurlex-diff-2018-06-20 eurlex-diff-2018-06-20
