Accordingly it must be held that, under the maxim ultra posse nemo obligatur (no one is obliged to do the impossible), and notwithstanding the rule in the first sentence of Article 74(1) of Regulation No 40/94 whereby OHIM shall examine the facts of its own motion', OHIM is not bound to examine facts showing that the mark claimed has become distinctive through use within the meaning of Article 7(3) of Regulation No 40/94 unless the applicant has pleaded them.
Rätten anser följaktligen, i enlighet med principen att ingen är förpliktad att göra någonting som är omöjligt (ultra posse nemo obligatur) och trots den regel som slås fast i artikel 74.1 första meningen i förordning nr 40/94, enligt vilken harmoniseringsbyrån "... utan särskilt yrkande [skall] pröva sakförhållandena", att en förutsättning för att harmoniseringsbyrån skall vara skyldig att pröva sakförhållanden, enligt vilka det varumärke för vilket det ansökts om registrering kan ha uppnått en särskiljningsförmåga till följd av användning i den mening som avses i artikel 7.3 i förordning nr 40/94, är att de har åberopats av sökanden.EurLex-2 EurLex-2
