154 However, as respect for the rights of the defence, a principle whose fundamental nature has been emphasised on many occasions in the case-law of the Court of Justice (judgment of 9 November 1983 in Nederlandsche Banden-Industrie-Michelin v Commission, 322/81, ECR, EU:C:1983:313, paragraph 7), is of crucial importance in procedures such as that followed in the present case, it is essential to prevent those rights from being irremediably compromised on account of the excessive duration of the investigation phase and to ensure that the duration of that phase does not impede the establishment of evidence designed to refute the existence of conduct susceptible of rendering the undertakings concerned liable.
154 Att iakttagandet av rätten till försvar utgör en grundläggande princip har vid flera tillfällen understrukits i domstolens praxis (dom av den 9 november 1983, Nederlandsche Banden-Industrie-Michelin/kommissionen, 322/81, REG, EU:C:1983:313, punkt 7). Eftersom det är av största vikt att nämnda rätt iakttas i sådana förfaranden som det förevarande är det viktigt att förhindra att rätten ohjälpligt kan äventyras på grund av att ett utredningsskede blir alltför utdraget och att denna tidsåtgång kan utgöra hinder för att skaffa fram bevis för att vederlägga ett påstående om att det har förekommit sådana beteenden som kan medföra ansvar för de berörda företagen.EurLex-2 EurLex-2
