The Asahi Shimbun pointed out that while in this case the court felt there was insufficient evidence that a contract existed in which both parties agreed that blood would not be used even in a life-endangering situation, the judges disagreed with the lower court on the legality of such contract: “If there is a well-advised agreement between the parties concerned that a blood transfusion should not be given under any circumstances, this Court does not deem it against public order and, hence, invalid.”
