En caso de respuesta negativa a la cuestión anterior, ¿deben interpretarse el principio de igualdad de trato establecido en el artículo 20 de la Carta, [así como] el principio general de buena fe y el aforismo fraus omnia corrumpit en el sentido de que, a efectos de la sanción a tanto alzado que ha de imponerse en virtud del artículo 16, apartado 3, de la Directiva 2003/87/CE y que conlleva automáticamente la publicación a la que se refiere el artículo 20, apartado 7, [de la Ley de 23 de diciembre de 2004], se oponen a que un operador de buena fe que ha actuado solo con negligencia, creyendo por lo demás haber cumplido sus obligaciones de entrega de derechos de emisión en la fecha límite del 30 de abril correspondiente, reciba el mismo trato que un titular que ha actuado de manera fraudulenta?
If the answer to the previous question is in the negative, must the principle of equal treatment enshrined in Article 20 of the Charter, the general principle of good faith and the principle ‘fraus omnia corrumpit’ be interpreted as precluding — as regards the penalty to be imposed pursuant to Article 16(3) of Directive 2003/87/EC, to which the publication provided for in Article 20(7) [of the Law of 23 December 2004] is automatically added — an operator acting in good faith, which is simply negligent and which furthermore believed that it had fulfilled its obligations to surrender emissions allowances by the relevant deadline of 30 April, from being treated in the same way as an operator which behaved fraudulently?Eurlex2019 Eurlex2019
