43 Oikeuskäytännössä on päätelty tästä, että sama vahinkoa kärsineiden suojaamisen tavoite edellyttää myös, että ajoneuvon kuljettamista varten vakuutetun henkilön, joka oli kuitenkin onnettomuuden tapahtuessa kyseisen ajoneuvon matkustajana, oikeudellinen tilanne rinnastetaan muiden onnettomuudessa vahinkoa kärsineiden matkustajien tilanteeseen ja ettei näin ollen henkilöä voida sulkea toisen direktiivin 2 artiklan 1 kohdassa tarkoitetun käsitteen ”vahinkoa kärsinyt kolmas” ulkopuolelle sillä perusteella, että hänet oli vakuutettu onnettomuuden aiheuttaneen ajoneuvon kuljettamista varten, jos hän oli kyseisen ajoneuvon matkustajana eikä kuljettajana (tuomio 1.12.2011, Churchill Insurance Company Limited ja Evans, C-442/10, EU:C:2011:799, 31 ja 32 kohta).
