21 Esitettyyn kysymykseen vastaamiseksi on aluksi palautettava mieliin yhteisöjen tuomioistuimen vakiintunut oikeuskäytäntö, jonka mukaan oikeusvarmuus ja valvonnan helppous edellyttävät, että tavaroiden tariffiluokittelun ratkaisevana luokitteluperusteena on yleensä oltava tavaroiden objektiivisesti todettavat ominaispiirteet ja ominaisuudet, sellaisina kuin ne on määritelty yhdistetyn nimikkeistön nimiketekstissä ja nimikkeistön jaksojen tai ryhmien huomautusten teksteissä (ks. mm. asia C-338/95, Wiener SI, tuomio 20.11.1997, Kok. 1997, s. I-6495, 10 kohta; asia C-339/98, Peacock, tuomio 19.10.2000, Kok. 2000, s. I-8947, 9 kohta ja asia C-479/99, CBA Computer, tuomio 7.6.2001, Kok. 2001, s. I-4391, 21 kohta).
21 For the purposes of the answer to be given to the national court's question, it should first be observed that it is settled case-law that, in the interests of legal certainty and ease of verification, the decisive criterion for the classification of goods for customs purposes is in general to be sought in their objective characteristics and properties as defined in the wording of the relevant heading of the Common Customs Tariff and of the notes to the sections or chapters (Case C-338/95 Wiener SI [1997] ECR I-6495, paragraph 10; Case C-339/98 Peacock [2000] ECR I-8947, paragraph 9, and Case C-479/99 CBA Computer [2001] ECR I-4391, paragraph 21).EurLex-2 EurLex-2
