49 Although, in the case in the main proceedings, the referring court does not call into question the finding in the report on the investigation carried out, to the effect that the Jamaican authorities did not know, and could not have known, that the textiles exported by ARH did not meet the conditions necessary in order for them to be regarded as being of Jamaican origin, the referring court is, by contrast, unsure whether the onus is on the Hauptzollamt to prove that the incorrect certificates were issued on the basis of false declarations by that company or whether, on the contrary, the onus is on Afasia to prove that ARH correctly presented the facts to the Jamaican authorities.
