22 Jotta voitaisiin lausua siitä, onko komission väite perusteltu, on heti alkuun otettava huomioon yhteisöjen tuomioistuimen oikeuskäytäntö, jonka mukaan se seikka, että jossakin tietyssä jäsenvaltiossa ei harjoiteta tiettyä, direktiivissä mainittua toimintaa, ei vapauta tätä jäsenvaltiota velvollisuudesta antaa lait tai asetukset tämän direktiivin säännösten riittävän täytäntöönpanon varmistamiseksi (ks. vastaavasti asia C-339/87, komissio v.
