2 Luonnonvaraisten lintujen suojelusta annetun direktiivin 79/409/ETY 4 artiklan 1 ja 2 kohdassa velvoitetaan jäsenvaltiot antamaan siinä tarkoitetuille erityissuojelualueille suojelun kannalta sellainen oikeudellinen asema, jonka avulla turvataan erityisesti direktiivin liitteessä I mainittujen lintulajien eloonjääminen ja pesintä sekä niiden säännöllisesti saapuvien muuttolintulajien pesintä, sulkasato ja talvehtiminen, joita kyseisessä liitteessä ei ole mainittu.
2 Article 4(1) and (2) of Directive 79/409 on the conservation of wild birds requires the Member States to provide the special protection areas referred to therein with a legal protection regime that is capable, in particular, of ensuring both the survival and reproduction of the bird species listed in Annex I to the Directive and the breeding, moulting and wintering of migratory species which are regular visitors, albeit not listed therein.

22 Niiden muiden toimien osalta, joilla Ranskan hallituksen mukaan pyritään antamaan erityissuojelualueelle suojelun kannalta riittävä asema, on huomattava, että yhteisöjen tuomioistuimen oikeuskäytännön mukaan lintudirektiivin 4 artiklan 1 ja 2 kohdassa velvoitetaan jäsenvaltiot antamaan erityissuojelualueille sellainen oikeudellinen asema suojelun kannalta, jonka avulla turvataan erityisesti direktiivin liitteessä I mainittujen lintulajien eloonjääminen ja pesintä sekä niiden säännöllisesti saapuvien muuttolintulajien pesintä, sulkasato ja talvehtiminen, joita liitteessä I ei ole mainittu (ks. vastaavasti asia C-355/90, komissio v. Espanja, tuomio 2.8.1993, Kok. 1993, 28-32 kohta ja em. asia komissio v. Ranska, tuomio 18.3.1999, 21 kohta).

failed to endow SPA IT 2040044 Parco Nazionale dello Stelvio with the legally protected status capable of guaranteeing, in particular, the survival and breeding of the species of birds mentioned in Annex I to Directive 79/409/EEC, (1) and the breeding, moulting and wintering of the migratory species not covered by Annex I which visit that locality regularly;

(7) Kun otetaan huomioon STECF:n lausunto, jonka mukaan tuulenkalojen vähäisyys on yhteydessä pikkukajavien pesinnän epäonnistumiseen, pyyntialueen sulkeminen ICES-suuralueella IV olisi pidettävä ennallaan lukuun ottamatta kyseisen kannan seuraamiseksi vuosittain harjoitettavaa rajallista kalastusta.
