Tältä osin direktiivin 96/71 1 artiklan 3 kohdan a alakohdasta, johon ennakkoratkaisua pyytänyt tuomioistuin nimenomaisesti viittaa kolmessa ensimmäisessä kysymyksessään, ilmenee, että direktiiviä sovelletaan erityisesti tilanteessa, jossa jäsenvaltioon sijoittautunut yritys, joka tarjotessaan valtioiden välillä palveluja lähettää työntekijöitä omaan lukuunsa ja omalla johdollaan toisen jäsenvaltion alueelle kyseisen lähettävän yrityksen ja tässä jälkimmäisessä jäsenvaltiossa toimivan palvelujen vastaanottajan välillä tehdyn sopimuksen nojalla, jos lähettävän yrityksen ja työntekijän välillä on työsuhde työntekijän lähetettynä olon ajan (tuomio 3.4.2008, Rüffert, C-346/06, EU:C:2008:189, 19 kohta).
