By decision of 9 May 2000, the Unabhängiger Verwaltungssenat im Land Niederösterreich (Independent Administrative Chamber for Lower Austria) (Austria) held Dr Biffl, as the managing director of Haarkos Parfumeriewaren und Kosmetika GmbH, to be in breach of Paragraphs 74(1), 9(1)(b) and 8(f) of the LMG, on the basis that the company had distributed the product 'Keralogie Creme-Peeling Anti Schuppen regulierendes Haarbad‘ (dandruff-controlling conditioner), whose packaging stated that it was 'dermatologically tested‘.

Biffl a été reconnu coupable d'une infraction administrative aux dispositions combinées des articles 74, paragraphe 1, 9, paragraphe 1, sous b), et 8, sous f), du LMG au motif qu'il était responsable de la mise sur le marché, par Haarkos Parfumeriewaren und Kosmetika GmbH, du produit cosmétique «Keralogie Creme-Peeling Anti Schuppen regulierendes Haarbad» dont le conditionnement (bouteille en plastique) porte l'indication «testé dermatologiquement», pour laquelle aucune autorisation n'avait été délivrée .
Hans Biffl (hereinafter: Dr Biffl') was found guilty by a decision of the Unabhängige Verwaltungssenat for Lower Austria dated 9 May 2000 of an administrative offence under Article 74(1) in conjunction with Articles 9(1)(b) and 8(f) of the LMG, on the ground that he had been responsible for the unauthorised marketing by Haarkos Parfumeriewaren und Kosmetika GmbH of the cosmetic product Keralogie Creme-Peeling Antischuppen regulierendes Haarbad', the packaging of which (a plastic bottle) was marked dermatologically tested'.

Linhart et Biffl ont en outre fait valoir que l'indication «testé dermatologiquement» figurant sur leurs produits est en soi correcte et ne saurait non plus, contrairement à ce que suggère la première question, induire le consommateur en erreur, étant donné la manière dont l'indication a été apportée sur le conditionnement.
Mr Linhart and Dr Biffl have further argued that the description dermatologically tested' appearing on their products is in itself correct and that, contrary to what the first question suggests, given the way in which the description is used on the packaging, it could not give the consumer the wrong impression.

Enfin, on peut encore ajouter que l'autorisation concernée, en tant que mesure tendant à la protection des consommateurs et de la loyauté des transactions commerciales, est encore plus disproportionnée si l'affirmation de M. Biffl selon laquelle des frais sont liés à la procédure de l'article 9, paragraphe 3, du LMG est fondée.
In conclusion, it should be added that the authorisation in question is even more disproportionate as a measure for protecting consumers and ensuring the fairness of trade if Dr Biffl's contention that the procedure under Article 9(3) of the LMG is not free of charge proves to be true.

S'agissant du rapport entre la directive 76/768 et la directive 84/450, c'est selon nous à juste titre que la Commission et MM.
