Il convient de se pencher, enfin, sur la violation de l’obligation de diligence tenant au fait, pour le Médiateur, d’avoir conclu, dans sa décision du 31 mars 2011, clôturant l’enquête d’initiative, à une absence de cas de mauvaise administration de la part du Parlement en relation avec les durées respectives d’inscription de Mme Staelen, d’une part, et des autres lauréats du concours général EUR/A/151/98, d’autre part, sur la liste d’aptitude, en se contentant, quant à cet aspect de l’enquête, d’une explication donnée par le Parlement sans s’être assuré que les faits sur lesquels reposaient cette explication étaient avérés.
113 Lastly, the Court must turn to the breach of the duty to act diligently arising from the fact that the Ombudsman concluded, in the decision of 31 March 2011 closing the own-initiative inquiry, that there was no maladministration on the part of the Parliament with respect to the periods of time for which Ms Staelen and the other successful candidates in Open Competition EUR/A/151/98 were, respectively, included on the list of suitable candidates, the Ombudsman having been content as regards that aspect of the inquiry with an explanation given by the Parliament, yet having failed to ensure that the facts on which that explanation was based were proved.eurlex-diff-2018-06-20 eurlex-diff-2018-06-20
