Ainsi qu’il ressort, notamment, des observations écrites du Royaume-Uni (voir points 37 à 43 ci-dessus) et des réponses des parties à des questions orales du Tribunal lors de l’audience, le principe de taxation «normale» sur lequel repose l’AGL est celui de l’exploitation commerciale au Royaume-Uni d’un matériau assujetti en tant que «granulat» [article 16, paragraphes 1 et 2, et article 17, paragraphe 1, du Finance Act 2001 (loi de finances pour l’année 2001, ci-après la «loi»)], sans que la loi prévoie une définition précise du terme «granulat» ou des critères généraux de taxation précisant ce terme, notamment en fonction des propriétés physico-chimiques, de la composition, de la taille ou de la valeur commerciale des matériaux concernés.
As is apparent, in particular, from the written observations of the United Kingdom (see paragraphs 37 to 43 above) and the answers given by the parties to the questions put by the General Court at the hearing, the ‘normal’ taxation principle underlying the AGL is the principle of the taxation of the commercial exploitation in the United Kingdom of a material that is taxable as an ‘aggregate’ (section 16(1) and (2), and section 17(1) of the Finance Act 2001; ‘the Act’), although the Act does not offer a precise definition of the term ‘aggregate’ or general taxation criteria explaining that term, inter alia by reference to the physico-chemical properties, composition, size or commercial value of the materials in question.EurLex-2 EurLex-2
