8 Tužitelj je nakon toga obavijestio CPVO da su u ispravljenoj verziji usporednog prikaza različitosti bile uočene druge pogreške, odnosno da u izmijenjenoj verziji navedenog dokumenta ocjena svojstva „boje lisne plojke” nije bila ispravljena.CPVO je 11. svibnja 2012. u vezi s tim potvrdio da je stupanj izražajnosti navedenog svojstva sorte M 02205 4 a ne 5.
8 Subsequently, the applicant informed the CPVO that other errors had come to light in the corrected version of the comparative distinctness report, namely that, in the corrected version of the document, the note corresponding to the ‘leaf blade colour’ characteristic had not been rectified.In that respect, the CPVO confirmed, on 11 May 2012, that the state of expression of variety M 02205 relating to that characteristic was 4 and not 5.

5 On 20 April 2012, the applicant, Aurora Srl, informed the CPVO that judicial proceedings were pending before the Italian courts — infringement proceedings initiated by the intervener against the applicant — and that an inconsistency had come to light in the certificate of registration for variety M 02205, namely that the states of expression relating to the characteristics ‘leaf blade colour’ and ‘leaf blade: undulation of the margin’, as included in the variety description, did not correspond to the states of expression in the comparative distinctness report (respectively, 4 instead of 5 and 5 instead of 4).

82 Kao prvo, u odgovorima na pisana pitanja Općeg suda CPVO se pozivao na argumente koji se odnose, s jedne strane, na ocjene koje su kasnije dodijeljen svojstvu „duljina korijena”, kako proizlaze iz metode izračuna koja se temelji na testu pod nazivom „najmanje značajne različitosti” i koja je po prvi put bila iznesena pred Općim sudom, te, s druge strane, na činjenicu da se u svakom slučaju na temelju rezultata usporednih uzgoja sorti u 2003. i 2004., i to u odnosu na svojstvo „boje lisne plojke”, sorta M 02205 i sorta KW 043 nesporno razlikuju.
82 In the first place, in its replies to the written questions put by the Court, the CPVO relies on arguments relating, on the one hand, to the subsequent notes added to the ‘root length’ characteristic, stemming from the calculation method based on the so-called ‘least significant difference’ test presented for the first time before the Court, and, on the other hand, to the fact that, in any event, varieties M 02205 and KW 043 are unquestionably distinct, based on the results from the comparative growing trials of 2003 and 2004, in view of the ‘leaf blade colour’ characteristic.

84 Furthermore, with regard to the ‘leaf blade colour’ characteristic, it must be observed that the CPVO’s argument contradicts its own previous finding — referred to in paragraph 8 above — that the ‘colour leaf blade’ characteristic was not relevant for the purpose of establishing the ‘distinctness’ requirement of the candidate variety.

Results of the research show high content of vitamin C in leaf lamina of 'Rialto' cultivar (162,09 mg/100g vitamin C), total phenols in leaf laminas of all tested cultivars (304,57 to 425,76 mg/L) and high lighting the parsley petiole of root parsleys cultivars ('Hablange', 'Arat', 'Eagle') in content of total phenols (151,22 to 165,12 mg/L).

Veća fotosintetska učinkovitost izmjerena je kod plojki u odnosu na peteljke listova, te je viša kod vrsta D. capensis i D. aliciae uzgajanih u vanjskim uvjetima, a kod vrste D. spatulata u sobnim uvjetima.
