76 Finally, with regard to the argument of the Finnish and French Governments, put forward at the hearing, according to which the rules established by Articles 27 and 28 of the Framework Decision are of fundamental importance — as shown both by the fact that those provisions do not appear in the Commission’s initial proposal (Proposal for a Council Framework Decision on the European arrest warrant and the surrender procedures between the Member States (COM(2001) 522 final/2)) and by the content of the first paragraph of each of those articles, which provides that, even where the Member States have initially renounced those rules, the executing judicial authorities may state otherwise in their decisions on surrender — it also cannot call the foregoing analysis into question.EurLex-2 EurLex-2
