(2) Il diritto di realizzare brevi estratti di cronaca comprende il diritto di registrare il segnale dell’emittente televisiva cui incombe l’obbligo previsto al paragrafo 1, nonché il diritto di realizzare e di trasmettere oppure di mettere a disposizione un breve estratto di cronaca alle condizioni previste ai paragrafi 3-5.
(2) The right to produce short news reports shall include the right to record the signal of the broadcaster who is subject to the obligation under subparagraph 1, and to produce and broadcast or provide a short news report under the conditions laid down in subparagraphs 3 to 5.

Scopo dell’articolo 15 della direttiva è quello di riconoscere alle emittenti televisive il diritto di realizzare brevi estratti di cronaca su eventi di grande interesse pubblico, trasmessi in esclusiva da un’emittente televisiva.

It follows that all television broadcasters, whether private or public, whether endowed with major financial resources or not, enjoy the right, under the same conditions, to produce short news reports on events of high public interest.

20 Quanto al merito, il Bundeskommunikationssenat ritiene che il diritto di realizzare brevi estratti di cronaca costituisca un’ingerenza nel diritto di proprietà, ai sensi dell’articolo 17 della Carta, dell’emittente televisiva che abbia contrattualmente acquisito in esclusiva i diritti di ritrasmissione relativi ad un evento di grande interesse pubblico (in prosieguo: il «titolare dei diritti esclusivi di trasmissione televisiva»).
