73 La Corte ne ha dedotto che, quando le attività delle istituzioni rientrano nell’ambito delle funzioni amministrative che sono loro specificamente attribuite dall’articolo 88 CE, occorreva tenere conto della circostanza che gli interessati diversi dallo Stato membro coinvolto nei procedimenti di controllo degli aiuti di Stato non avevano il diritto di consultare i documenti del fascicolo amministrativo della Commissione e, pertanto, di riconoscere l’esistenza di una presunzione generale in base alla quale la divulgazione dei documenti del fascicolo amministrativo avrebbe pregiudicato, in linea di principio, la tutela degli obiettivi delle attività di indagine, con la conseguenza che l’istituzione interessata avrebbe potuto anche esimersi da un previo esame concreto e individuale dei documenti di cui trattasi.
73 The Court of Justice concluded that, where the activities of the institutions fall within the framework of administrative duties which are specifically allocated to them by Article 88 EC, it was necessary to take account of the fact that interested parties other than the Member State concerned in the procedures for reviewing State aid did not have the right to consult the documents in the Commission’s administrative file, and, therefore, to acknowledge the existence of a general presumption that disclosure of documents in the administrative file might, in principle, undermine the protection of the purpose of investigations, with the result that the institution concerned could itself decide that a specific and individual prior examination of the documents concerned was unnecessary.EurLex-2 EurLex-2
