Nel corso della sua audizione il signor Yannick Geffroy, imputato nel procedimento penale, eccepiva a sua difesa, quanto alla mancanza di etichettatura in francese: che la Coca-Cola era stata acquistata in Gran Bretagna; che si trattava di un prodotto arcinoto; che il consumatore non poteva sentirsi disturbato da un'etichettatura in lingua inglese da tutti facilmente comprensibile; che vi era un cartello recante la traduzione di tali etichette, ma che con tutta probabilità un cliente lo aveva fatto cadere in fondo allo scaffale; e che i fornitori dei sidri Merry Down e delle birre Red Raw avevano commesso un errore non fornendo gli adesivi in lingua francese destinati a essere incollati sulle bevande, diversamente da quanto loro richiesto.
3 In court, Mr Geffroy, who is the defendant in the criminal proceedings, pleaded in his defence, as to the lack of labelling in French: that the Coca-Cola drinks had been bought in Great Britain; that this was a well-known product; that the consumer could not consider himself inconvenienced by labelling in English which could be easily understood by anybody; that there was a sign giving a translation of those labels, but that a customer had probably made it fall to the bottom of the display unit; and that the suppliers of Merrydown ciders and Red Raw beers had made a mistake by not providing stickers in French for attachment to those drinks, as they had been requested to do.EurLex-2 EurLex-2
