45 Kā pamatoti apgalvo Komisija savos rakstveida apsvērumos, tas, ka paralēlais importētājs nav uzlīmējis preču zīmi uz jaunā ārējā iepakojuma (marķējuma noņemšana) vai uz tā ir attēlojis pats savu logo, vai izmantojis sava uzņēmuma stilu, vai arī “noformējumu”, vai tādu noformējumu, kas izmantots vairākām dažādām precēm (kopīgs marķējums), tāpat kā tas, ka uz iepakojuma ir vai nu uzlīmēta papildu etiķete, pilnībā vai daļēji aizklājot īpašnieka preču zīmi, papildu etiķetē nav minēts, ka attiecīgā preču zīme pieder konkrētam preču zīmes īpašniekam, vai arī paralēlā importētāja nosaukums ir uzrakstīts ar lielajiem burtiem, principā var kaitēt preču zīmes reputācijai.
