The Commission therefore submits that the Court should declare that, by authorising the operation of the Žilina — Považský Chlmec waste site without a conditioning plan for the waste site and without adopting a definite decision on whether operations might continue on the basis of the said conditioning plan, the Slovak Republic has failed to fulfil its obligations under Article 14(a), (b) and (c) of Council Directive 1999/31/EC of 26 April 1999 on the landfill of waste.

Om het in het besluit tot inleiding van de procedure uiteengezette risico van vervalsing van de mededinging te voorkomen en om hun veronderstelling met betrekking tot het effect van de terminal op de overgang van goederenvervoer van weg op spoor te toetsen, hebben de Slowaakse autoriteiten besloten het project te beperken tot de bouw van één enkel proefproject, namelijk de terminal in Žilina-Teplička.
In order to avoid the risk of distortion of competition, as set out in the decision initiating the procedure, and in order to test their assumption regarding the impact of the terminal on shifting goods transport from road to rail, the Slovak authorities undertook to limit the project to building a single pilot project terminal in Žilina-Teplička.
