(61) Het betoog van Arbois dat hij bij het vaststellen van de genoemde clausules niet besefte inbreuk te maken op de concurrentieregels van het Verdrag en dat hij daarvan evenmin door zijn juridische raadslieden in kennis was gesteld, kan zoals uit het arrest van het hof van Justitie in de zaak Miller International (1) blijkt, niet worden aanvaard om deze onderneming van de gepleegde inbreuk vrij te pleiten.
(61) Arbois's claim that it was unaware that it was infringing the Treaty competition rules when it agreed the offending clauses and that its legal advisers failed to alert it to the fact is not sufficient to exonerate it from responsibility for an infringement, according to Court of Justice in the Miller International case (1).

(44) In this clause Polistil agreed to sell its products to Arbois at prices such that Arbois itself could keep its resale prices competitive in order, among other things, to 'combat possible competition from foreign importers of Polistil products or Italian wholesalers'.

(64) Om deze redenen meent de Commissie, rekening houdend met de bovenvermelde gegevens, Polistil en Arbois een geldboete te moeten opleggen waarvan het bedrag is aangegeven in artikel 2 van deze beschikking,
(64) On these grounds and having regard to the circumstances just mentioned, the Commission considers that fines should be imposed on Polistil and Arbois in the amounts laid down in Article 2 of this Decision,

(46) Voorts bedoelde deze clausule aan Arbois - die er zich trouwens op liet voorstaan ten opzichte van Polistil (zie punt I.D) - de mogelijkheid te geven, niet alleen de concurrentie van produkten die van dezelfde aard zijn als de contractprodukten te verhinderen, maar eveneens deze van contractprodukten die eventueel door het parallel afzetkanaal zouden geïmporteerd zijn, door deze afzet te ontmoedigen en zelfs de werking ervan te verhinderen.
(46) Moreover, this clause - which Arbois in fact invoked vis-à-vis Polistil (see section I.D) - was intended to allow Arbois not only to impede competition from products similar to those covered by the contract but also to discourage or prevent parallel imports of the latter.

(23) b) Polistil belooft al het mogelijke te doen om er voor te zorgen dat de aan Arbois berekende prijzen laatstgenoemde de mogelijkheid geven concurrerende wederverkoopprijzen toe te passen ten opzichte van soortgelijke produkten en een eventuele concurrentie van buitenlandse importeurs van Polistil produkten of van Italiaanse grossiers het hoofd te bieden (artikel 1, lid 3).
(23) (b) Polistil will do its best to ensure that the prices it charges Arbois allow Arbois to keep its resale prices competitive with those of similar products and to combat possible competition from foreign importers of Polistil products or Italian wholesalers (Article 1 (3)).

Beide partijen wisten namelijk of hadden moeten weten dat deze clausules die zijn ingevoerd om nevenimport te verhinderen en Arbois een absolute gebiedsbescherming te verzekeren beperkingen van de concurrentie konden vormen welke artikel 85, lid 1, verbiedt. Temeer omdat de Commissie en het Hof van Justitie zich bij herhaling tegen clausules waarbij een absolute gebiedsbescherming wordt toegekend hebben uitgesproken.
The two parties knew or should have known that these clauses, which had been written into the contract to prevent parallel imports and give absolute territorial protection to Arbois, were apt to constitute restrictions of competition contrary to Article 85 (1); the more so as the Commission and the Court of Justice have repeatedly condemned clauses seeking to guarantee absolute territorial protection.

(32) For a meeting to be held in Paris on 30 and 31 October 1979 Arbois asked Polistil to bring along 'the file on orders from Repetto in 1979, the 1980 Italian wholesale price-list and the 1980 Arbois price-list, which must be at least 15 % below the prices to Italian wholesalers to put a stop to the competition by Crystève Diffusion'.

(33) Bij brief van 23 mei 1980 wijst Arbois Polistil erop dat de firma Timky rechtstreeks van Italiaanse grossiers Polistil speelgoed importeert dat zij aan Franse detailhandelaren zou verkopen tegen hetzelfde tarief als het grossierstarief van Arbois.
(33) On 23 May 1980 Arbois wrote to Polistil reporting that a firm called Timky was importing Polistil toys direct from Italian wholesalers and selling them to French retailers at prices that were the same as Arbois's prices to wholesalers.
